Mjp Building Services - General Terms and Conditions of Service (Revised)

These Terms and Conditions (the "Terms") govern the provision of building and construction services by Mjp Building Services (the "Contractor") to the Client. By accepting a quote or instruction for work, the Client agrees to be bound by these Terms.

0. Client Classification

0.1. Client Definition: For the purposes of these Terms, the Client is categorized as a "Consumer Client" if they are an individual acting for purposes that are wholly or mainly outside that individual's trade, business, craft, or profession. The Client is categorized as a "Business Client" otherwise.

1. Scope of Work

1.1. The Contractor shall carry out the works and services (the "Works") as detailed in the agreed-upon quotation or scope document provided to the Client.

1.2. Any variation or addition to the Works must be agreed upon in writing by both the Client and the Contractor before the additional work commences, and may result in a revision of the quoted price and/or completion timeline.

2. Payment Terms

2.1. Invoice Payment: All invoices issued by Mjp Building Services are due and payable immediately upon the date of receipt.

2.2. Late Payment (Business Clients Only): If the Client is a Business Client and payment is overdue, the Contractor reserves the right to charge interest on overdue amounts at the rate set out in the Late Payment of Commercial Debts (Interest) Act 1998, plus the fixed compensation for debt recovery costs set out in that Act.

2.3. Late Payment (Consumer Clients Only): If the Client is a Consumer Client and payment remains overdue after the date of receipt, the Contractor reserves the right to add a fixed administrative fee of £35.00 to the outstanding balance. This fee represents a genuine pre-estimate of the administrative and recovery costs incurred by the Contractor in addressing the late payment.

2.4. Deposits and Staged Payments: For larger projects, the Contractor may require a non-refundable deposit or staged payments, as detailed in the initial quotation.

3. Materials and Goods Sourcing

3.1. Standard Materials Supplied by Contractor:

a. The Client will be charged the Contractor’s actual purchase cost for the materials.

b. An additional 20% management, sourcing, and handling fee will be applied to the material cost price.

3.2. Sourcing of Large and Specific Items:

a. The Contractor can facilitate sourcing these items through established trade accounts, providing them to the Client at the Contractor’s cost price.

b. Client Direct Payment (Preferred Method): The Contractor prefers and encourages the Client to pay the relevant suppliers directly for these large items. If the Client chooses to pay the supplier directly, this removes the need for the Contractor to finance the purchase and streamlines the transaction.

4. Other Trades and Subcontractors

4.1. The Client acknowledges that the completion of the Works may require specialist services from third-party trades (e.g., electricians, plumbers, plasterers) and/or subcontractors, whether introduced by the Contractor or sourced independently by the Client.

4.2. Client's Direct Payment Obligation: The Client is solely responsible for the direct payment of all invoices issued by these third-party trades, specialists, or subcontractors.

4.3. Mjp Building Services will not process, advance, or guarantee payment to any third-party trade, and the timely execution of the Works is dependent upon the Client's prompt payment to these parties.

5. Client Responsibilities

5.1. The Client is responsible for ensuring clear access to the site and providing necessary services (water, electricity) required for the Works.

5.2. The Client is responsible for obtaining any necessary planning permissions, building control approvals, or landlord consent required for the Works prior to commencement, unless otherwise agreed in writing.

6. Insurance and Liability

6.1. The Contractor maintains Public Liability Insurance.

6.2. The Contractor shall not be liable for any existing defects, latent or otherwise, in the structure or fabric of the property upon which the Works are executed.

7. Governing Law

7.1. These Terms shall be governed by and construed in accordance with the laws of England and Wales
